About these terms

Fundy is operated in New Zealand. By creating an account or placing a bid you accept these terms and the fundraiser rules. If you do not accept them, do not use Fundy.

Fundy is a brand by Ashtro Limited, 3 Moenui Avenue, Orewa, New Zealand.

We may change these terms. If a change matters to you, we will email you before it takes effect.

Your account

You must be 18 or older to hold an account. Keep your password to yourself; you are responsible for what happens under your sign in. Tell us straight away if you think someone else has access.

What Fundy is, and is not

Fundy is a platform that connects organisations running fundraisers with the people who back them. Fundy is not a party to the agreement between a club and a sponsor.

• The club sets the spots, the reserves and the conditions.
• The club invoices the sponsor and delivers what it promised.
• Fundy does not hold funds on kit fundraisers, and does not guarantee any outcome.

No gambling, raffles or prize draws

Every payment on Fundy buys a stated thing. The sponsor knows what they get before they pay, and nothing is decided by chance.

Fundy is not gambling and does not run, promote or assist gambling. There are no draws, tickets, prizes, pools or stakes.

• You must not run, attach, advertise or imply any raffle, lottery, sweepstake, prize draw, spot prize, instant win or other chance based promotion on or through Fundy.
• You must not attach a prize to a name spot or a number. A number lets someone back a person. It is not an entry into anything.
• You must not use any Fundy page, link, number or fundraiser as an entry into a draw you run elsewhere, including on social media.
• You must not use any supporter details collected through Fundy in a prize draw or chance based promotion.
• You confirm all of this every time you publish or update a fundraiser, by ticking the boxes on the review step. We record when you ticked them and which account did it.
• The 5 percent Fundy keeps is a platform service fee for the technology and the card processing. It is not a commission for running any other kind of fundraising activity.
• You must not use Fundy to promote an overseas gambling operator or website.
• If we think a fundraiser is being used for anything this section bans, we can take it down and suspend the account straight away, with no notice and no refund of our fee. We may report it to the Department of Internal Affairs and give them our records.
• If you break this section, you cover any fine, cost or loss Fundy takes on because of it, including the cost of defending it.

Fees

Kit fundraisers are free while we test and improve Fundy. On a team fundraiser Fundy keeps 5 percent of what comes in, GST included, and that covers card processing and administration costs. This may change in the future as Fundy scales.

Payments

Card payments run through Stripe. Fundy never sees or stores your card number. Stripe's own terms apply to that payment.

Content you upload

You keep ownership of your own information and content. You give Fundy permission to display that information and content on the platform for as long as your fundraiser or account is live. Do not upload anything you do not have the right to use.

Liability

Fundy is provided as is. To the extent the law allows, Fundy is not liable for indirect or consequential loss, for a club failing to deliver, or for a sponsor failing to pay. A kit fundraiser runs on bids, but Fundy never holds the money. The club invoices the winning sponsor, who pays the club directly.

Ending your account

You can close your account any time from My account. Fundy will check your fundraisers and sponsors have been settled before closing. We may suspend or close an account that breaks these terms or the fundraiser rules.

Law

Fundy is for fundraisers run in New Zealand. New Zealand law governs these terms and this website, and the New Zealand courts settle any dispute.
